Pinacate Tours (hereinafter “THE AGENCY”), with its address at Camino del Seri 96, Las Praderas, 83288, Hermosillo, Sonora, Mexico, treats our customers’ information confidentially.

PERSONAL DATA AND HOW IT IS COLLECTED.

“THE AGENCY” will collect from you only the personal data essential for providing the contracted services and for ensuring your safety while those services are in effect.

The data that may be requested includes: – Full name (required) – Contact details: address, mobile or office telephone and email (required) – Date of birth and age (required) – Signature (optional) – Bank accounts, as shown by deposits made to “THE AGENCY” (automatic and for reference) – Personal image through photographs and/or video (optional) – Profiles on social networks such as Facebook, Instagram, WhatsApp or other electronic platforms (optional and according to the relevance of the service)

Information about a third-party emergency contact may also be requested, including their name and contact details, for the sole purpose of dealing with any unforeseen situation while the services are being provided. “THE AGENCY” will collect from you the personal data essential for providing the services contracted with “THE AGENCY” and/or its subsidiaries or associates, and for seeking to ensure your safety in case of emergencies while the contracted services are in effect. Such personal data may include the following: name, contact details such as address, mobile or office telephone and email, photographs and/or video and/or any other visual medium (and the personal image derived from it), signature, date of birth, age, bank accounts as shown by deposits made to “THE AGENCY”, Facebook, Instagram or WhatsApp profile, or any other electronic medium and/or social network.

We may also require information about third parties related to you, such as their name and contact details, in case of emergencies arising while services are being provided.

PURPOSES AND TRANSFER OF PERSONAL DATA. By providing your personal data, you consent to its processing and understand that it may be processed directly or indirectly by “THE AGENCY”, its affiliated or related companies and/or third-party suppliers with which it has a legal and/or commercial relationship, and, where applicable, competent authorities, for the following purposes: i) offering you products or services of “THE AGENCY”, ii) complying with legal requirements, iii) carrying out statistical and market analysis, iv) keeping our records up to date in order to answer your enquiries, follow up our commercial relationship and manage collections, v) using your data for the purpose of transferring it to subsidiaries and affiliates of “THE AGENCY” so that they can contact you and offer you services and products. To prevent unauthorised access to your personal data and to ensure that the information is used for the purposes set out in this Privacy Notice, we have established physical, electronic and administrative procedures that limit the use or disclosure of your data and allow us to process it properly. You can also be confident that your personal data will be processed only by those persons who need to know it.

You agree that “THE AGENCY” may transfer your personal data to: i) Mexican or foreign affiliates and subsidiaries, for the purposes set out in this Privacy Notice or for such purposes as they may communicate to you, ii) individuals or legal entities, as necessary for the proper provision of the services of “THE AGENCY”, iii) requests from a judicial authority, following a written request that meets the legal requirements.

Likewise, you accept and authorise that the photographs and/or videos taken while the service is being provided, as well as the personal data provided to “THE AGENCY”, may be used by it for advertising and/or marketing purposes, without this implying the payment of any sum to you, your dependants and/or representatives for the use of that image. If you do not want your personal image to be used for advertising purposes, you may say so in writing to contacto@pinacate.tours or directly when you register, so that the necessary measures are taken to ensure your decision is respected.

REQUESTS TO EXERCISE ARCO RIGHTS AND REVOCATION. You may correct information that is inaccurate or incomplete and may also exercise your rights of Access, Rectification, Cancellation or Opposition (ARCO) regarding your personal data, in writing addressed to Pinacate Tours at the following address: Camino del Seri 96, Las Praderas, 83288, Hermosillo, Sonora, Mexico, or by email to contacto@pinacate.tours. The request must contain: I. The name of the data subject and their address or other means of sending them the response to their request; II. The documents proving the identity or, where applicable, the legal representation of the data subject; III. A clear and precise description of the personal data regarding which one of the above rights is to be exercised; and IV. Any other element or document that makes it easier to locate the personal data.

You may also revoke the consent you have given “THE AGENCY” for processing your personal data that is not essential for fulfilling the obligations arising from the legal relationship between you, so that “THE AGENCY” stops using it. To do so, you must submit your request in the terms set out above.

If the request is submitted by a person other than the Data Subject, that person must present the legal document that proves they are entitled to do so, attaching a plain copy of the official identification of the Data Subject and of the legal representative.

We will respond to your request under the terms established in articles 28 to 35 of Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties.

USE OF COOKIES. Cookies are text files that are automatically downloaded and stored on the hard drive of the user’s computer when browsing a specific web page, and that allow the web server to remember some information about that user, including their preferences for viewing the pages on that server, name and password.

We inform you that we use cookies to obtain the following information, which allows us to adapt, improve and personalise the presentation of our website to our customers’ preferences: i) Your browser type and operating system. ii) Your IP address. iii) Information related to your visit to our website.

CHANGES TO THE NOTICE. This Privacy Notice may be modified from time to time by “THE AGENCY”. Such changes will be announced in due course at https://www.pinacate.tours, or through any other oral, printed or electronic means of communication that “THE AGENCY” determines for that purpose.

LEGAL. Under the terms of this Privacy Notice, you are informed that, for the interpretation and/or fulfilment of the above terms and conditions of security, privacy and legality, both the Data Subject and “THE AGENCY” shall be governed by the Federal Law on the Protection of Personal Data Held by Private Parties and its complementary regulations and, in the event of disputes, agree to submit to the jurisdiction of the competent Courts of the State of Sonora, waiving any other jurisdiction that may correspond to them by reason of their present and/or future domiciles or for any other reason. Under the terms of this Privacy Notice, you are informed that, for the interpretation and/or fulfilment of the above terms and conditions of security, privacy and legality, both the Data Subject and “THE AGENCY” shall be governed by the Federal Law on the Protection of Personal Data Held by Private Parties and its complementary regulations and, in the event of disputes, agree to submit to the jurisdiction of the competent Courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present and/or future domiciles or for any other reason.

CONSENT. In accordance with articles 8, 9, 13 and 36 of the Federal Law on the Protection of Personal Data Held by Private Parties, I hereby: i) acknowledge that I have read and understand the scope of the Privacy Notice of “THE AGENCY”, ii) expressly authorise “THE AGENCY” to collect my personal data for the purposes set out in, and in accordance with, this Privacy Notice, as it may be modified from time to time, and the applicable legal provisions, and iii) expressly authorise the distributor to transfer my personal data in accordance with, and to the persons set out in, this Privacy Notice, including but not limited to the subsidiaries, affiliates and/or individuals and legal entities that help it fulfil its commitments, as it may be modified from time to time, and the applicable legal provisions.
